What is a HIPAA Release?
HIPAA Release is a document that allows a person you designate to have access to your medical information. We generally mirror the Medical Power of Attorney document. The person listed in your HIPAA release will present the signed HIPAA Release to a health care provider or another entity in the event that they need to discuss your medical records in connection with your Medical Power of Attorney.
What does HIPAA mean?
It stands for the Health Insurance Portability and Accountability. Oftentimes, people will misspell HIPAA as HIPPA.
When is a HIPAA Release Effective?
In our documents, we state that, “this Authorization is effective immediately and has no expiration date.” But we can insert an expiration date and we can have the authorization start at a certain time.
What do we include in the HIPAA Release?
It is also worth noting that the following is included, “my refusal to sign this form will not stop disclosure of health information that has occurred prior to revocation or that is otherwise permitted by law without my specific authorization or permission, including disclosures to covered entities as provided by Texas Health & Safety Code § 181.154(c) and/or 45 C.F.R. § 164.502(a)(1).”
